§1 GENERAL PROVISIONS 1. This regulation defines the rules for making purchases in the online store of GP Elektro Automatic Sp. z o.o. - https://gpautomatic.pl/ by GP Elektro Automatic Sp. z o.o., Inwalidów Wojennych 10, 43-603 Jaworzno, Tax Identification Number: 632-201-05-62. 2. The terms used in the regulation mean: a. Customer - a natural person (having full legal capacity) or a legal entity who has made or intends to make a purchase in the online store of GP Elektro Automatic Sp. z o.o.. The customer can be both a consumer and a business entity. b. Seller - GP Elektro Automatic Sp. z o.o., Inwalidów Wojennych 10, 43-603 Jaworzno, Tax Identification Number: 632-201-05-62. c. Store - an online store maintained by the Seller in the domain https://gpautomatic.pl/. d. Consumer - according to the Civil Code Act of April 23, 1964 - a user who, as a natural person, performs a legal act not directly related to their economic or professional activity. Consumers, within the meaning of this Regulation, also include entrepreneurs conducting individual economic activities and concluding contracts that do not have a professional character resulting from the subject of their activities. e. User Account - an account in the Store assigned to a specific Customer, containing the data provided during registration. f. Regulation - this document along with all attachments. 3. The Store offers industrial automation, industrial pneumatics, industrial hydraulics, electronics, and electrical materials for retail and wholesale through the internet. The above-mentioned products are available through the Store in the form of finished goods. 4. Detailed information about the products can be found on the website https://gpautomatic.pl/, as well as provided via email to the Seller's email address. 5. The Customer can contact the Seller by mail at the address indicated in point 2b and by electronic means at the email address: sales@gpea.pl. §2 TERMS OF SERVICE USAGE 1. In order to place an order through the Store, the Customer must meet the following technical requirements: a. Have a computer, laptop, or other device with internet access. b. Have access to email. c. Use an internet browser (using the latest version is recommended). d. Use a minimum screen resolution of 1024x768. e. Enable the browser to save cookies. 2. The online store provides electronic services in the form of: a. Registration of an Account and maintenance of the User Account. b. Order form. c. Contact form. 3. The Store does not charge any fees for providing the above-mentioned services. 4. The above services are provided for an indefinite period. The Customer may resign from a specific service at any time without stating a reason by sending an appropriate email message to the Seller's email address. The Customer may withdraw from the agreement for the provision of any service within 14 days from the date of placing the order, as indicated above, without stating a reason. §3 CONCLUSION OF CONTRACTS 1. The contract is concluded between the Seller and the Customer. 2. All prices listed on the Store's website are gross prices (including VAT) in Polish zlotys. The product prices do not include shipping costs. 3. If applicable to a specific product, the Seller takes due care to ensure that the product photos reflect their color, nature, texture, and condition. Due to various factors such as screen resolution, calibration, and brightness of the Buyer's computer screen on which the photos are displayed or the use of different devices, there may be slight variations in the actual appearance of the product. 4. Placing an order in the Store requires the following steps: a. Selection of the desired product by adding it to the shopping cart. b. Reviewing the contents of the shopping cart, including the selected products, quantities, and prices. c. Providing the necessary information for the order, such as delivery address, contact details, and payment method. d. Confirmation of the order by clicking the appropriate button. 5. By confirming the order, the Customer makes a binding offer to purchase the selected products from the Seller. 6. After receiving the order, the Seller will send an order confirmation to the Customer's email address provided during the ordering process. The order confirmation will include the order details, total cost, and any additional information related to the order. 7. The contract between the Seller and the Customer is considered concluded upon the receipt of the order confirmation by the Customer. 8. The Seller reserves the right to refuse an order in the following cases: a. Unavailability of the product or insufficient stock. b. Inability to verify or authenticate the Customer's payment information. c. Discovery of an error in the product information, including the price or description. d. Suspected fraudulent activity or violation of the Store's terms and conditions. 9. In the event of the Seller's refusal to accept an order, the Customer will be informed promptly, and any payment made by the Customer for the rejected order will be refunded. §4 PAYMENT METHODS 1. The Store provides the following payment methods: a. Bank transfer - The Customer will receive the necessary bank account details to make the payment. The order will be processed after the payment is confirmed. b. Online payment - The Customer can use the available online payment options provided by the Store during the ordering process. 2. The Seller reserves the right to introduce or withdraw specific payment methods without prior notice. 3. In the case of international orders, the Customer is responsible for any additional fees, such as currency conversion charges or bank fees. §5 DELIVERY 1. The Seller provides delivery services to the specified address within the territory of Poland and, if agreed upon, internationally. 2. The delivery costs and estimated delivery time are specified during the ordering process and may vary depending on the selected delivery method, destination, and order size. 3. The Seller is responsible for ensuring that the products are properly packaged and protected for shipping. 4. The risk of damage or loss of the products passes to the Customer upon delivery. 5. In the event of visible damage to the package or products during delivery, the Customer should immediately report it to the courier and refuse to accept the shipment. A damage report should be prepared together with the courier. 6. Any complaints regarding the delivery should be reported to the Seller as soon as possible, providing all relevant details and supporting documentation. §6 PRODUCT WARRANTY AND RETURNS 1. The Seller is responsible for providing warranty for the products in accordance with the applicable laws and regulations. 2. The warranty period and conditions are specified in the product description or warranty card provided with the product. 3. The Customer has the right to withdraw from the purchase within 14 days from the date of receiving the products, in accordance with the applicable laws and regulations. The Customer should notify the Seller about the withdrawal and return the products in their original condition and packaging, unless the products were damaged or defective. 4. The Seller will reimburse the Customer for the returned products, including the original shipping costs, within 14 days from the date of receiving the withdrawal notification and returned products. However, the Seller may withhold the reimbursement until the products are received or until the Customer provides proof of their return, whichever occurs first. 5. The Customer is responsible for the cost of returning the products unless the return is due to the Seller's fault, such as delivering incorrect or defective products. 6. The Seller reserves the right to refuse the return of products that are not in their original condition or packaging, or if there is evidence of excessive use or damage caused by the Customer. §7 PERSONAL DATA PROTECTION 1. The Seller collects and processes the Customer's personal data in accordance with the applicable privacy laws and regulations. The Seller's Privacy Policy provides detailed information on how personal data is collected, used, and protected. 2. By using the Store and providing personal data, the Customer agrees to the Seller's Privacy Policy and acknowledges that their personal data may be processed for the purposes described therein. §8 INTELLECTUAL PROPERTY RIGHTS 1. All content available on the Store, including text, images, graphics, logos, and trademarks, is protected by intellectual property laws and belongs to the Seller or its licensors. 2. The Customer may not reproduce, modify, distribute, or use any of the Store's content without the Seller's prior written permission. §9 LIMITATION OF LIABILITY 1. The Seller shall not be liable for any direct or indirect damages, including but not limited to loss of profits, data, or business opportunities, arising from the use or inability to use the Store or the purchased products. 2. The Seller's liability for any damages is limited to the total amount paid by the Customer for the specific order that caused the damages. 3. The limitations of liability apply to the maximum extent permitted by the applicable laws and regulations. §10 FINAL PROVISIONS 1. The Seller reserves the right to modify these Terms and Conditions at any time without prior notice. The modified Terms and Conditions will become effective upon their publication on the Store's website. 2. Any disputes arising from or related to these Terms and Conditions or the use of the Store shall be subject to the jurisdiction of the courts competent for the Seller's registered office. 3.
